The actress has been slapped by a right-to-live lawsuit filed on behalf of the frozen embryos, which she and ex Nick Loeb created in 2013 and are now named 'Emma' and 'Isabella.'
Sofia Vergara's legal battle with her ex-fiance Nick Loeb over their frozen embryos is not over. On Tuesday, December 6, things just worsened when a right-to-live lawsuit was filed against the actress on behalf of the fertilized eggs that are now named "Emma" and "Isabella."
Page Six, which first reported the news, says that the suit has been filed in Louisiana which the publication notes is "a traditionally pro-life state that offers special legal protections for frozen embryos." James Carbonett is listed as a plaintiff and the "trustee" to the female embryos.
The lawsuit states that since Emma and Isabella are never born, they're deprived of an inheritance from a trust created for them in Louisiana. The plaintiff now wants the frozen embryos to be given to Loeb so they can be born via a surrogate and live off the trust, which would cover their health care and education among others.
Vergara and Loeb created the embryos in 2013, when they were still a couple and trying to have a baby together. After two rounds of IVF failed, they broke up in the following year. Loeb has been seeking control over the embryos since then, while his ex-fiancee wants them to stay "frozen indefinitely."
After their breakup, Vergara moved on with Joe Manganiello. The "Modern Family" star, who's already a mom to 24-year-old son Manolo, married her now-husband last year.
